These Terms of Service govern your access to and use of UrgencyKit, including our website, dashboard, image generation services, hosted countdown image URLs, and any related features.
By creating an account or using UrgencyKit, you agree to these Terms. If you do not agree, you must not use the service.
You may use UrgencyKit only if you are legally able to enter into a binding agreement.
If you use UrgencyKit on behalf of a company, agency, client, or other organisation, you confirm that you have authority to accept these Terms on their behalf.

UrgencyKit provides dynamic image generation tools. We do not send emails on your behalf unless a specific email-sending feature is introduced later.

You must not use UrgencyKit to mislead recipients, hide material terms, or create deceptive urgency.
Published campaigns may generate public image URLs that can be embedded in emails or websites.
Anyone with access to the public image URL may be able to load the generated image.
You should not include confidential, sensitive, or private information in campaign images or countdown URLs.
We may block or disable public image URLs that violate these Terms or create security, abuse, or operational risks.

If your usage exceeds plan limits, we may ask you to upgrade, temporarily limit rendering, apply a watermark, restrict new campaign publishing, or take other reasonable steps to protect the service.

We are not responsible for losses caused by temporary unavailability, rendering delays, broken email-client image loading, caching behaviour, or third-party platform restrictions.
Email clients and email platforms may cache, proxy, block, resize, or otherwise alter images.
UrgencyKit cannot guarantee that every recipient, email client, or platform will display images exactly as intended.
You are responsible for testing your campaigns before sending them.
UrgencyKit may provide image-load analytics.
These analytics are estimates based on image requests and related technical data. They should not be treated as guaranteed unique human opens.
Email clients, privacy proxies, image caching, security scanners, and automated systems may affect analytics accuracy.
UrgencyKit, including our software, design, branding, code, logo, and platform features, belongs to us or our licensors.
You may not copy, reverse engineer, resell, or misuse the platform except as allowed by these Terms.
You must not use UrgencyKit to:
We may suspend or terminate your access if you breach these Terms, fail to pay applicable fees, your usage creates risk to the platform, we are required to do so by law, or your account is involved in abuse, fraud, or security incidents.
You may stop using UrgencyKit at any time.
UrgencyKit is provided on an "as is" and "as available" basis.
To the maximum extent permitted by law, we do not guarantee that the service will always be available, generated images will display perfectly in every email client, analytics will be perfectly accurate, use of countdowns will increase sales or conversions, or the service will meet every business requirement.
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, failed campaigns, or business interruption.
Where liability cannot be excluded, our total liability will be limited to the amount you paid to UrgencyKit in the three months before the claim arose, unless applicable law requires otherwise.
We may update these Terms from time to time.
If changes are material, we will make reasonable efforts to notify users.
Continued use of UrgencyKit after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of South Africa, unless another jurisdiction is required by applicable consumer law.
